A FATHER put his young toddler's life at risk by driving while over the limit with her in the car and without a seatbelt, magistrates heard.
Raul Carvalho (40) of Sotheron Street, Goole, was nearly three times the limit when he was stopped by police in his Ford Mondeo at Drax early on March 25.
Steve Ovenden, prosecuting, said the defendant's 22-month-old daughter wasn't wearing a seatbe
lt and the child seat wasn't restrained.
He said: "If there had been any accident, there would have been significant risk of injury to the child."
Carvalho, a team leader at English Village Salads in Camblesforth, was arrested after failing a breath test and taken into custody.
Checks at the police station later revealed 95 microgrammes of alcohol in 100 millilitres of breath – the legal limit is 35.
Carvalho admitted drink-driving and having an unrestrained child in his car at a previous court hearing, and the case was adjourned for reports.
He was handed 16 weeks' imprisonment, suspended for 24 months, banned from driving for four years and ordered to pay £50 costs when he appeared before Selby magistrates, sitting in York, last week.
Shaun Pinchbeck, mitigating, said his client had enjoyed a few drinks with friends the day before the incident, including two shots of whiskey.
He said: "Carvalho then slept for some hours. His partner was working and due to finish at 3am.
"There's only one car in the family, so he drove to work to go and collect her. It wasn't possible to leave his daughter at home, so he took her with him."
Mr Pinchbeck added: "Carvalho bitterly regrets the fact he drove at all – and especially because he didn't ensure his daughter was restrained in the car seat."
The solicitor told magistrates his client had now gone tee-total because he was "shocked and horrified" by his actions.
