A PLANNED trial of a 72-year-old Barlby man on a drink drive offence has been vacated because of possible abuses in the way the taking of his blood may have come to light.
Victor John Marden, of Turnhead Crescent, was due to stand trial before Selby magistrates last Friday on a charge of driving his Rover car along Barlby Road, Selby, on May 11, last year, with an alcohol reading in blood of 96mg – the legal limit for driving being 80mg
However, magistrates heard on Thursday (February 7) that there was a question about how the statutory option to give blood was administered to the profoundly deaf Marden.
Philip Brown, defending, said that a possible breach of procedure was being investigated and that a statement from the nurse, who was present in the police station and took the sample of blood from Marden, was required before a trial could be held.
The hearing was adjourned for one week when it expected that a new trial date will be set.
